1. Acceptance of Terms
By accessing this website, you fully and unconditionally accept these Terms and Conditions of Use.
2. Parental Consent for Minors
Written consent from parents or legal guardians is required in the following cases:
When participating in conversations with French peers.
When video recording of the Mock Oral Exam (DELF/DALF) by the teacher has been selected for educational purposes.
The official consent form is available in the document titled "Parental Consent Form." Parental consent is required once and remains valid for all future oral sessions.
3. Privacy & Data Protection
The collection and processing of personal data are carried out in accordance with applicable data protection laws, including, but not limited to, the General Data Protection Regulation (EU Regulation 2016/679 – GDPR).
4. Proper Use
All users are required to comply with established content guidelines, ensuring that any shared material remains appropriate, respectful of others, and aligned with community standards. Any form of inappropriate behavior—including, but not limited to, offensive language, harassment, discrimination, hate speech, or sharing obscene, violent, or otherwise inappropriate content—is not tolerated during oral sessions. Violation of these rules may result in immediate disciplinary action. User accounts may be suspended or permanently terminated in the event of a breach of these Terms and Conditions or involvement in inappropriate behavior. In such cases, the user is not entitled to a refund. Users are obligated to promptly report any inappropriate behavior or related incidents during Oral Sessions to the Francofilia management team.
Minors: All oral interactions involving minors are subject to real-time monitoring by authorized personnel to ensure safety and content appropriateness. These sessions are not recorded, unless the teacher of french has asked for.
5. Video Recording and Sharing
Observers, such as parents, legal guardians, or instructors, are permitted to attend during oral sessions, provided they remain passive observers. They are not allowed to intervene, speak, or be visible during the conversation between users. Recording, storing, taking screenshots, or distributing the conversations by any means is strictly prohibited without prior, explicit, and written authorization from the Francofilia platform.
French Teachers of Minors: Only French teachers have the right to request audiovisual material (video) of Mock Oral Exams, exclusively for educational purposes. If the teacher does not request the recording of the Mock Oral Exam, it will not be recorded.
Unauthorized recording and/or distribution of any oral session constitutes a serious breach of these terms and may result in:
Suspension of the account and/or
Legal actions, in accordance with applicable data protection and intellectual property laws.
7. Parental Responsibility
Parents/guardians must oversee their child’s activities and ensure they attend scheduled sessions.
Cancellations: Allowed up to 8 hours before the scheduled appointment without penalty. Cancellations within 8 hours are non-refundable.
No-Show Policy: No refund will be issued for missed or canceled appointments after the deadline.
8. Security and Protection of Personal Information
The website implements stringent security measures, including, but not limited to, two-factor authentication and content filters, to protect users and their data. Sharing sensitive personal information during oral communications, such as phone numbers, addresses, or other personal data, is strictly prohibited and may result in immediate suspension or termination of the user's account.
9. Session Rescheduling, Cancellations & Technical Issues
Rescheduling and Fees: Sessions postponed due to technical issues will be rescheduled at no extra charge.
Instructor/Interlocutor Absence:
- Missed sessions will be rescheduled at no cost to students.
- More than two absences in three months may result in reduced payment or suspension of privileges.
Student Absence:
- No-show students are not eligible for free rescheduling unless a valid reason is provided.
- More than three absences within two months may require an additional fee for future bookings.
Last-Minute Cancellations:
By Instructors/Interlocutors:
- Cancellations within 24 hours may result in a payment deduction unless justified.
- More than two last-minute cancellations in three months may restrict scheduling privileges.
By Students:
- Cancellations within 24 hours may not qualify for free rescheduling.
- More than three last-minute cancellations in two months may require an additional booking fee.
Platform Downtime:
- If technical issues prevent access, sessions will be rescheduled at no charge.
- Repeated service disruptions may result in partial refunds or credit toward future sessions.
10. Exclusivity Clause
Users agree not to directly contract with or employ instructors or interlocutors from the platform during their enrollment and for one year afterward.
11. Videoconference Dress Code - Appropriate attire for online sessions
11.1 General Principle
All participants in videoconference sessions (students, teachers, and correspondents) are required to wear appropriate attire that respects the educational setting.
11.2 Dress Requirements
Appropriate attire includes:
Mandatory wearing of clothing that covers the torso and shoulders
Avoiding transparent, low-cut, or revealing clothing
Favoring clean and neat attire
Avoiding clothing with offensive, discriminatory, or inappropriate messages
11.3 Examples of Acceptable Attire
Shirt, polo shirt, t-shirt, or sweater
Jacket or cardigan
Any attire you would wear in a traditional professional or educational environment
11.4 Consequences of Non-Compliance
Failure to comply with this rule may result in:
A warning from the coordinator of Francofilia
A request to modify attire before continuing the session
In case of repeated violations, temporary suspension of access to online sessions
11.5 Exceptions
Exceptions may be granted for medical reasons or under special circumstances, subject to prior agreement with the administration.
This rule aims to maintain a respectful and professional learning environment for all participants.
12. Confidentiality Agreement
- Examination materials and teacher-student communications must remain confidential.
- Unauthorized sharing or distribution is strictly prohibited.
13. Third-Party Services Integration
Users acknowledge and agree to comply with terms of third-party services integrated into the platform (e.g., payment processors, video tools).
14. Limitation of Liability
The platform is not liable for direct, indirect, incidental, or consequential damages arising from the use of its services.
15. Modification of Services
The platform reserves the right to modify, suspend, or discontinue services at any time, with or without notice.
